Terms of Service

1. Definitions

  • "Service" — the automated installation and configuration of a mail server performed by cripta.to, together with the Ancillary Services described in section 4.
  • "Installation" — the one-time, automated deployment and configuration of a mail server (including DNS configuration and TLS certificate setup) onto Your Infrastructure.
  • "Ancillary Services" — the backup, security-update, and monitoring activities cripta.to performs for a running Mail Environment during an active subscription, as described in section 4.
  • "Mail Environment" — a mail server installed by the Service and running on Your Infrastructure.
  • "Your Infrastructure" — the cloud-provider account (e.g. Hetzner) that you own and control, into which the Mail Environment is deployed.
  • "Customer", "you" — the person or entity that creates an account and uses the Service.
  • "Consumer" — a Customer who is a natural person acting for purposes outside their trade, business, craft or profession, within the meaning of the Italian Consumer Code (Codice del Consumo, D.lgs. 206/2005).

2. Description of Service

cripta.to provides the automated installation and configuration of a mail server onto Your Infrastructure, and — during an active subscription — the Ancillary Services described in section 4. The Installation includes DNS configuration, TLS certificate management, and mail-server setup automation.

cripta.to is not a mail hosting provider or email operator. The Mail Environment runs on Your Infrastructure and remains under your control at all times. You are the operator of the Mail Environment and are solely responsible for its operation, availability, deliverability, security, content, and legal compliance. cripta.to has no responsibility for the operation of the Mail Environment.

3. Your Responsibilities

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your cloud provider credentials and SSH keys.
  • You must comply with all applicable laws when operating mail servers, including anti-spam regulations (e.g. CAN-SPAM, GDPR).
  • You must not use the Service to send unsolicited bulk email (spam) or for any illegal purpose.
  • You are responsible for all costs incurred on your cloud provider account (e.g. Hetzner compute charges).
  • You are responsible for your sending reputation and email deliverability, which are built over time through how you send mail and are not something cripta.to can provide or guarantee.

4. Ancillary Services — Backup, Security Updates, Monitoring

While your subscription is active, cripta.to performs certain routine activities for your Mail Environment for your convenience: automated backups, application of security updates, and basic monitoring.

These Ancillary Services are provided on a reasonable-efforts basis only. cripta.to gives no guarantee, warranty, or service-level commitment of any kind in relation to them. Without limitation, cripta.to does not guarantee that backups will be complete, current, or restorable, that security updates will be timely or free of defects, or that monitoring will detect or prevent any issue. The Ancillary Services do not make cripta.to the operator of the Mail Environment and do not relieve you of your responsibility for your own backups and for the operation of the Mail Environment.

5. Acceptable Use

You may not use the Service to:

  • Send spam, phishing emails, or malware.
  • Engage in activities that violate applicable laws or regulations.
  • Attempt to gain unauthorised access to other systems or users' infrastructure.
  • Resell or sublicense the Service without written permission.

Violation of this policy may result in immediate suspension or termination of your account.

6. API Credentials and Security

You provide cloud provider API tokens to enable the Service. These credentials are stored encrypted in AWS Secrets Manager. cripta.to will only use them to perform actions you explicitly request (deploying or destroying Mail Environments) and to provide the Ancillary Services while your subscription is active. You may revoke or rotate these credentials at any time.

7. No Warranty

To the maximum extent permitted by applicable law, the Service and the Ancillary Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. cripta.to does not warrant that the Service will be uninterrupted, error-free, or that it will meet your requirements.

This section applies without prejudice to the mandatory rights of Consumers under the Codice del Consumo and other applicable mandatory law, which are not excluded or limited by these Terms.

8. Service Availability

cripta.to provides the Service on a best-efforts basis. We do not guarantee uninterrupted or error-free operation of the automation platform or of the Ancillary Services, which may be suspended from time to time for maintenance without liability. Your Mail Environment operates independently and will continue to run even if cripta.to experiences downtime.

9. Fees, Subscription, and Refund

The Service is charged as a one-time Installation fee plus a recurring subscription fee, billed in advance. Compute and other charges for Your Infrastructure (e.g. Hetzner) are billed to you separately by the relevant cloud provider and are not included in cripta.to's fees.

14-day refund. If you are not satisfied, you may request a full refund of the subscription fee within 14 days of your first subscription payment. Once the Installation has been performed, the one-time Installation fee is non-refundable, as it covers work already delivered. This refund does not apply to any Customer who has breached section 5 (for example by sending spam, engaging in abuse, or acting unlawfully). This commercial refund is separate from, and in addition to, the statutory right of withdrawal described in section 10.

10. Consumer Right of Withdrawal

If you are a Consumer, you have a statutory right to withdraw from the contract within 14 days of entering into it, without giving any reason (Articles 52 ff. of the Codice del Consumo).

Because the Installation begins immediately, when you place your order you expressly request that cripta.to begin performing the Service during the withdrawal period and acknowledge that you lose your right of withdrawal once the Service has been fully performed (Article 59(1)(a) Codice del Consumo). This express request and acknowledgement are captured in the onboarding flow before deployment begins. If you withdraw after performance has begun but before it is complete, you may be charged for the part of the Service already provided.

11. Cancellation and Data Export

You may cancel your subscription at any time. For managed deployments, the Mail Environment and its associated DNS records are destroyed at the end of the billing period. Before destruction, cripta.to provides a full backup and export of your mail data in standard formats so that you can migrate to another provider or self-host. For BYO-provider deployments (where the server runs in your own cloud account), cancellation stops billing but does not touch the server. The server remains in your account under your control — we do not destroy or back it up. You are responsible for retrieving and retaining any data you wish to keep; cripta.to is not obliged to keep a copy after cancellation.

12. Limitation of Liability

To the maximum extent permitted by applicable law, cripta.to shall not be liable for any indirect, incidental, special, or consequential damages, including data loss, arising from your use of the Service. cripta.to is not liable for the operation, downtime, data loss, deliverability, or blacklisting of the Mail Environment, which is operated by you. Our total liability shall not exceed the fees you paid to cripta.to in the twelve months preceding the claim.

Nothing in these Terms excludes or limits cripta.to's liability for wilful misconduct (dolo), gross negligence (colpa grave), death or personal injury caused by its negligence, or any other liability that cannot be excluded or limited under mandatory applicable law, including the mandatory rights of Consumers.

13. Data Protection

cripta.to processes personal data as described in our Privacy Policy. cripta.to does not access or process the content of the emails you send or receive; your Mail Environment runs on Your Infrastructure.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will provide reasonable notice of material changes via email or in-app notification. If you are a Consumer, you may terminate the contract before a material change takes effect.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy. If you are a Consumer, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence (Article 6 of the Rome I Regulation), and any dispute may be brought before the courts of the place where you are domiciled. For all other Customers, the courts of Torino, Italy shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
